An Ekiti State High Court sitting in Ado Ekiti has sentenced an 18-year-old man, Emeka Emmanuel, to 10 years imprisonment without an option of fine for raping a seven-year-old girl.
In his ruling, Justice Lekan Ogunmoye said the victim’s medical report, confession of the defendant (now convict) and his request for forgiveness as well as his statement corroborated the fact that the prosecution had successfully proved the element of the offense of rape.
The prosecutor, Wale Fapohunda, who is Ekiti State Attorney General, said the defendant, who was a sales boy near the victim’s mother shop, lured the girl into his boss’ shop and raped her on a bag of beans.
Fapohunda said the defendant committed the offence on May 12 and 20, 2019 at Ado- Ekiti, the state capital.
According to him, the offense contravened Section 31(2) of the Child’s Right Law CAP, C7 Laws of Ekiti State of Nigeria, 2012.
The defense counsel, Chris Omokhafe, who called only one witness, urged the court to be lenient in its judgment, pleading for the consideration of the age of the defendant.
