The Lagos State High Court in Igbosere will on December 9 rule on a Motion on Notice filed by Transnational Haulage Limited to enforce a N58,756,500 arbitral award against Lafarge Africa Limited.

In the Motion on Notice filed by its lawyer, Bodurin Adewole, before Justice Taofikat Oyekan-Abdullahi, Transnational Haulage Limited is also seeking a simple annual interest of 12 per cent on the arbitral award, given in its favour on November 4, 2019 by Mrs Funmi Roberts of the Chartered Institute of Arbitrators.

The Chief Executive Officer of Transnational Haulage Limited, Akin Ososanya, claimed, in an affidavit filed in support of the Motion on Notion, that since the arbitral award was published on November 4, 2019 and its certified true copy issued on January 14, 2020, the award debtor/respondent (Lafarge) has not responded or reacted in any manner whatsoever.

But Lafarge has, through its lawyer, Segun Ololade, opposed Transnational Haulage’s suit and urged the court to set aside the N58.7m arbitral award on the grounds that the Sole Arbitrator, Roberts, went beyond her jurisdiction.
